Heard learned counsel for the petitioners and Sri Sanjay Ram Tripathi, learned Standing Counsel for the State respondents.
By means of the present writ petition, the petitioners have prayed for a writ in the nature of mandamus directing the respondents not to interfere in their peaceful marital life and also not to harass them in any manner.
Learned counsel for the petitioners submits that petitioners are major and have solemnized their marriage as per Hindu rituals. It is further submitted that petitioners are being threatened and harassed by respondents for reason of having thus got married.
Learned Standing Counsel appearing for the State-respondents on the basis of instructions states that an FIR vide Case Crime No. 1139 of 2019, under Sections 363, 366 IPC at P.S. Highway, District Mathura has already been registered against petitioner no. 2 (husband), copy of the instruction is taken on record.
In view of the aforesaid, learned counsel for the petitioners prays that the petition may be dismissed as withdrawn to take appropriate recourse under the law.
Learned Standing Counsel appearing for the State-respondents has no objection to the prayer so made.
As prayed, the writ petition is dismissed as withdrawn.
