1. Short counter affidavit filed today. Taken on record.
2. Heard Sri Satyendra Sharma, learned counsel for the applicants; Sri Kripa Shanker Mishra, learned counsel for the opposite party no.2 and learned A.G.A. for the State.
3. The present 482 Cr.P.C. application has been filed to quash the summoning order dated 29.07.2017 passed in Complaint Case No. 12126 of 2016 (Neha Gupta Vs. Smt. Anju Gupta @ Awantika Gupta & Ors.), under Sections- 323, 504, 506, 379 IPC, Police Station- Collectorganj, District- Kanpur Nagar, pending in the court of Additional Chief Metropolitan Magistrate-IX, Kanpur Nagar.
4. Learned counsel for the applicants submits that the present dispute arises out of matrimonial discord between the applicant no.1 and brother of opposite party no. 2. He further submits that arising from the same matrimonial discord, by a separate order passed today in Application U/S 482 No.14129 of 2017 (Rishabh Gupta & 2 Ors. Vs. State of U.P. & Anr.), cross criminal prosecution lodged by opposite party no.2 (applicant no.1 herein) against her husband and his family members has been quashed.
5. In view of the reasons contained in the aforesaid order and on the same terms, the proceedings of the aforesaid case against the applicants are hereby quashed.
6. The present application is accordingly allowed.
