The petitioner (Ved Prakash Aggarwal) appearing in person seeks a direction in the nature of mandamus commanding the respondent no.3 to take action against the respondent no.8 who has constructed multiplex in the name of Sonic World' 448-K, Lakhanwali Road Surajpur, Greater NOIDA, Gautam Budh Nagar.
The contention in the writ petition is that the petitioners had applied for the allotment of shop in the multiplex owned by the respondent no.8. Though the lease rent had been paid but the shops-in-question have not been handed over to the petitioners.
Sri Amit Shukla learned counsel for the respondent no.8 submits that another writ petition has been filed earlier by the petitioners for the same relief. They have approached several authorities for redressal of their grievances though an allotment letter has already been issued to them. The respondent no.8 had issued several letters to the petitioners to come and take possession of the shop but instead of giving any response, he has approached this Court and different authorities in order to harass the respondent no.8.
Be that as it may, the dispute being raised herein is private in nature, appropriate remedy for the petitioners is to file a civil suit in case of any contravention of the terms and conditions of agreement/contract on the part of the respondent no.8.
The writ petition is, accordingly, dismissed.
