Learned counsel appearing on behalf of the petitioners submitted that the term of the contract has been expired. The Division Bench of the High Court, Lucknow Bench, Lucknow in the case of Dr. Devendra Pratap Singh and others vs. Union of India, reported in 2011 (7) ADJ 169 has held that the ANM is entitled to continue in service till the scheme continues and, therefore, the petitioners are entitled to continue and for a direction, the present application has been moved.
Learned Standing Counsel submitted that a week's time may be allowed to seek instruction.
List on 6.7.2012. In the meantime, the Chief Medical Officer, Sonbhadra may consider for the continuance of the engagement of the petitioners in the light of the aforesaid decision of the Division Bench of the High Court, Lucknow Bench, Lucknow.
