JUDGMENT / ORDER

Supplementary affidavit filed by the learned counsel for the applicant is taken on record.
Heard learned counsel for the applicant and learned counsel for the A.G.A. for the State as well as perused the record.
The accused-applicant Anjani Kumar @ Tinku Tiwari is involved and detained in Case Crime No. 1048 of 2009, under Sections 3(1) U.P. Gangster Act, from Police Station Raunahi, District Faizabad and he has applied for bail.
The submission of the learned counsel for the accused applicant is that a criminal history of three cases have been shown against the accused applicant in the gang chart and in all the cases the accused applicant is on bail.
It is further submitted that this case under U.P. Gangsters and Anti-social Activities (Prevention) Act has been slapped on the accused applicant by the police, in vengeance, so that the accused applicant may languish in jail for a considerable long period. The accused applicant is in jail since 16.02.2010 as averred in para 2 of the bail application.
Learned A.G.A. opposed the bail application.
Considered the submissions of the learned counsel for the applicant and the learned Additional Government Advocate. Keeping in view the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, accused applicant may be released on bail.
Let the applicant Anjani Kumar @ Tinku Tiwari be enlarged on bail in the aforesaid case crime number on his furnishing a personal bond of two sureties each in the like amount to the satisfaction of the court concerned.
