The petitioner has preferred this writ petition for the following reliefs:
"(i) A writ, order or direction in the nature of mandamus be issued commanding the opposite parties to execute the registered sale deed of the Plot No.14 H.I.G. Type-2 Area 216 Square meter Goutam Vihar Vistar Avasiya Yozana Gorakhpur in the favour of petitioner and also may be mutated the name of petitioner on the place of Janaklata Chand.
(ii) A writ, order or direction in the nature of mandamus be issued commanding the Opposite Party No-5 to conclude the enquiry pending before him in accordance with law within a stipulated period and also kindly may be summon the records of Gorakhpur Development Authority.
(iii) A writ, order or direction in the nature of mandamus may also be issued to the oposite parties to take legal action against the officers, other officials, so called Ramesh Verma, Smt Renu Verma and Smt. Janaklata Chand who are involved in the fraud."
Heard Sri Ravindra Kumar Yadav, learned counsel for the petitioner, Sri K.R.Singh, Advocate who has put in appearance on behalf of respondent nos. 2,3,4 and 6 and Learned Standing Counsel who has accepted notice on behalf of the State Functionaries.
In view our order no notice is required to be issued to the private respondent as we have protected his interest in the matter.
Sri Singh on the instruction submits that an enquiry in respect of the grievance of the petitioner is under progress and it is likely to be concluded in a short time.
In view of the above statement, we find that the ends of justice requires that an opportunity be granted to the petitioner to move a fresh representation before the respondent no.3 for redressal of his grievance. In the event any representation is made within two weeks, the respondent no.3 shall pass an appropriate order after furnishing an opportunity to respondent no.7. The aforesaid exercise shall be completed expeditiously preferably within three months from today.
With the aforesaid observation the writ petition is disposed of.
