Learned counsel for the petitioner submits that she may be allowed to implead "Managing Director, Purvanchal Vidhut Vitran Nigam Ltd., Lucknow, Uttar Pradesh" as respondent no. 5 in the array of the parties to the writ petition.
She is permitted to do so during the course of the day.
Heard Ms. Afshan Shafaut, learned counsel for the petitioner; Shri F.A. Ansari holding brief of Shri Mahboob Ahmad, learned counsel for the respondent no. 4 and newly impleaded respondent no. 5 as well as learned Standing Counsel for the respondents no. 1, 2 & 3.
Due to an unfortunate incident on 23.4.2018 the elephant of the petitioner died due to electricity shock upon being coming in contact with 11,000 volt wire. By order dated 30.5.2018 after enquiry it was found that the said incident was verified to be correct and it was held that the electricity department is liable to pay compensation and the matter was referred to the appropriate authority, but till date no orders for determining the compensation have been passed by the authority concerned which in the present case is stated to be the respondent no. 5.
The writ petition is disposed of with the direction that the respondent no. 5 shall consider the representation of the petitioner, which would be filed within 15 days from today, and pass appropriate order as far as possible within one month from the date a certified copy of this order along with fresh representation is presented before it.
With the aforesaid direction, the writ petition is disposed of.
