The applicant has come up with a prayer to expedite the proceedings of Case No. 837 of 2019, Smt. Anjali vs. Amit Kumar, under Section 125 Cr.P.C., Police Station Rampur Maniharan, District Saharanpur pending in the court of the learned Principal Judge, Family Court, Saharanpur.
The applicant is a wife in distress. It is submitted that proceedings of the Maintenance Case are lingering on. The Court has perused the order sheet of the case from 19.08.2019 to 03.11.2020 which is on record.
It must be remarked that proceedings for maintenance are inherently urgent in nature as these are designed to provide immediate relief to a destitute wife or minor children.
Looking to the nature of the order that this court proposes to pass, no notice is being issued to opposite party no. 2. However, in case the said opposite party feels aggrieved, it will be open to him to make an application in this decided application.
In the circumstances, the Principal Judge, Family court, Saharanpur where Misc. Case No. 837 of 2019, Smt. Anjali vs. Amit Kumar, under Section 125 Cr.P.C., Police Station Rampur Maniharan, district Saharanpur is pending, is ordered to expedite proceedings of the case and endeavour to conclude the same within a period of three months next in accordance with law after hearing all parties concerned. In case, there is any application for interim maintenance pending, the same shall be disposed of within one month next from the date of receipt of that application. However, in the event there is any interim order of stay by a Court of superior jurisdiction, this order will not operate.
In terms of the above orders, this application is allowed.
