Anjali Singh vs State Of U P And Another

High Court Of Judicature at Allahabad|17 December, 2021
|

JUDGMENT / ORDER

Court No. - 40
Case :- WRIT - C No. - 32108 of 2021 Petitioner :- Anjali Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Gyanendra Singh Kanaujiya Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J. Hon'ble Vikram D. Chauhan,J.
Petitioner's application for issuance of caste certificate has been rejected on the ground that she is now married and can apply for such certificate from where her husband resides.
Learned counsel for the petitioner points out that the caste certificate is required for applying against Advertisement No. 1 of 2021 issued by the U.P. Secondary Education Service Selection Board, Prayagraj, as per which, in case of female candidates, the certificate issued from address of the father alone would be admissible.
The advertisement of the Board is at Annexure No. 1 and the petitioner's claim that she requires certificate from her father's place and that such certificate alone would be valid is clearly substantiated from the advertisement.
In such circumstances, the authorities are not justified in declining the issuance of caste certificate to the petitioner from her father's place.
In the facts of the case, this petition is disposed of with the direction upon the Collector, Kaushambi to ensure that petitioner is issued a caste certificate with her address mentioned of her father within four weeks from the date of making such application before the office concerned.
