Sri Krishna Kant Vishwakarma, learned counsel for the petitioner submits that the marks of the petitioner in the subject of Hindi, as recorded in the marksheet of Intermediate Examination, issued by the respondent Board, is 33. Upon perusal of the answersheet, the petitioner found that the aggregate of her marks was incorrect. The correct total of marks found upon perusal of the answersheet was 78. The petitioner has moved an application for correction for issuance of corrected marksheet.
Learned Standing Counsel submits that the respondent Board is under obligation of law to decide the representation and issue a correct marksheet to the petitioner in case incorrect marks have been transcribed in the marksheet within a reasonable period of time.
In light of the aforesaid submission, the matter is remitted to the respondent no. 2, Secretary, Madhyamik Shiksha Parishad, U.P., Prayagraj.
A writ of mandamus is issued commanding the respondent no. 2, Secretary, Madhyamik Shiksha Parishad, U.P., Prayagraj to decide the application of the petitioner for correction in the marks in the subject of Hindi, as recorded in the marksheet of Intermediate Examination-2019, issued by the respondent Board, within a period of four weeks from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind in accordance with law.
The writ petition is disposed of finally.
