The instant petition has been filed praying for a mandamus commanding respondents no.2 and 3 to conclude investigation in F.I.R. dated 10.02.2020 registered as Case Crime No.0074 of 2020, under Section 302 IPC and 3(2)(V) of SC/ST Act, P.S. Nawabganj, District Prayagraj and also to effect arrest of respondent no.4.
The petitioner is the first informant and wife of the deceased. It is pointed out that the police has submitted a charge sheet against some of the accused persons but investigation against respondent no.4 is still pending. It is submitted that the Investigating Officer is not properly conducting the investigation and the same is causing delay in conclusion of the same.
Sri Awadh Bihari Pandey has entered appearance on behalf of respondent no.4. He does not dispute that investigation against respondent no.4 is still in progress.
Having regard to the submissions made, the instant petition is disposed of with direction to respondents no.2 and 3 to ensure that the investigation against respondent no.4, which is stated to be in progress, is concluded expeditiously, preferably within a period of twelve weeks from the date of production of a true attested copy of the instant order before these respondents.
