Heard Sri K.N.Tripathi, learned counsel for the petitioners and Sri Arvind Kumar, learned A.G.A. for the State respondents.
Learned A.G.A. points out that there is no material to show that the marriage of the petitioners is registered and in view thereof, the factum of marriage becomes doubtful, and the present petition seeking a writ of habeas corpus to regain custody of the petitioner, stated to be wife, would not be entertainable.
Learned counsel for the petitioners has fairly submitted that the marriage of the petitioners is not registered.
In view of the aforestated facts, this Court is not inclined to entertain the present petition seeking a writ of habeas corpus.
The petition stands accordingly dismissed.
