This writ petition coming on for Preliminary Hearing, this day, the court made the following.
ORDER Petitioner being the defendant No.2 in a declaratory suit filed by the respondent in O.S.No.169/2018 is invoking the writ jurisdiction of this Court seeking a direction to the learned trial Judge to take up his applications in I.A.Nos.1 & 2, copies whereof are at Annexures- C & E, for consideration.
2. I have heard the learned counsel for the petitioner and have perused the petition papers; having notice to respondent dispensed with since prayer of the petitioner is innocuous.
This Court directs learned jurisdictional City Civil Judge, to take up the said applications for consideration and dispose after hearing other side in accordance with law, within an outer limit of 45 days.
