After having heard Sri Sushil Shukla, learned counsel appearing on behalf of petitioners, we do not find any merit in the prayer seeking the quashing of F.I.R. registered vide case crime no. 78A of 2010 under sections 323, 504, 506, 452, 352 I. P. C. police station Phoolpur District Allahabad. However, considering the nature of allegations and also the defence of previous and the current litigation between the parties, we trust that the Magistrate who shall handle the prayer for bail, shall not frustrate the aspirations of petitioners and pass an appropriate order of bail in their favour as and when they surrendered before him, with a copy of the present order. It is also presumed that the Public Prosecutor is also issued proper notice after having been served a copy of the petition upon him.
With the above observations, the writ petition stands dismissed.
