1. Heard Sri Alok Dwivedi, learned counsel for the petitioners; Sri Pranesh Dutt Tripathi, learned counsel for the respondent nos. 2 and 3 and; learned Standing Counsel for the State- respondents.
2. Petitioners are members of Scheduled Caste. They claim entitlement for appointment against twenty two vacant posts reserved for member of the Scheduled Caste and nine vacant posts reserved for Scheduled Tribe. Reliance has also been placed on certain earlier orders of this Court.
3. Sri Pranesh Dutt Tripathi, learned counsel appearing for the respondent nos. 2 and 3 submits that there are factual aspects involved in the present case inasmuch as it is not clear whether any vacancy is available and what steps have been or could have to be taken to fill up the vacancy, if any.
4. No useful purpose would be served in keeping this writ petition pending. The same is disposed of with the following observations and directions:
(i) the petitioners may file a fresh representation alongwith a certified copy of this order before the respondent no.2 - Secretary, Uttar Pradesh Basic Shiksha Parishad, Allahabad within a period of two weeks from today;
(ii) it is expected that upon such representation being filed by the petitioners, the respondent no.2 - Secretary, Uttar Pradesh Basic Shiksha Parishad, Allahabad may proceed to decide the same strictly, in accordance with law as expeditiously as possible, preferably within a period of one month from the date of filing such representation;
(iii) all other consequential actions, if any, may be taken in pursuance of the decision to be made by the respondent no.2 - Secretary, Uttar Pradesh Basic Shiksha Parishad, Allahabad.
