Heard learned counsel for the petitioner and Sri Sanjay Singh, learned counsel for the respondent Nos. 2 & 3 and Sri Ashutosh Pandey, learned counsel for the respondent No.4 .
In pursuance of the notice under Section 13(2) of the Secularization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the petitioner has filed objections under Section 13(3)(A) of the Act on 27.09.2018. The apprehension of the petitioner is that without deciding the said objection, the respondent would proceed challenged with the recovery. The apprehension of the petitioner is ill founded.
In view of the above, we dispose of the petition with the direction that the respondents before proceeding further would consider and decide the above objection of the petitioner in accordance with law.
In case the respondent Bank finds that no objection has been filed by the petitioner, it will intimate the petitioner.
We permit the petitioner to file fresh objections within two weeks.
The petition is disposed of accordingly.
