Animal Rescue Organization Rep. by its Secretary Gopal Rao Surabathula R/o.3-141/12 Dathasai Nagar Madhavapatnam Kakinada East Godavari district and another … Petitioners And Government of A.P., Rep. by its Principal Secretary Municipal Administration & Urban Development Secretariat Buildings Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION NO.183 OF 2014 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed having found inaction on the part of sixth respondent - Municipal Corporation as well as the fifth respondent – Andhra Pradesh Pollution Control Board, despite a complaint lodged against running of an illegal slaughter house situated at Quresh Road, Azad Chowk, Jampet, Rajahmundry.
Learned counsel for the respondent Municipal Corporation submits upon instructions that for running the slaughter house, no permission has been taken. It is further submitted that the Municipal Corporation is planning to take action in accordance with law.
Learned counsel for the Pollution Control Board says that the Board will take steps in accordance with law, if any action is required to be taken.
Taking note of the submissions of the learned counsel appearing for the parties, we dispose of the writ petition directing the Municipal Corporation authorities and the Pollution Control Board to take steps in accordance with law. In the event action is to be taken, obviously seventh respondent shall be served with a notice and shall also be given personal hearing. After such hearing and after passing a speaking order, action shall be taken. The entire exercise shall be completed within a period of eight weeks from the date of communication of this order.
With the above directions, the writ petition is disposed of. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall also stand dismissed.
