JUDGMENT / ORDER

The petitioner herein is a Bus Conductor. He has been facing prosecution on the allegation that he declined to carry student passengers in his vehicle. The petty case charge sheet against him under Sections 190 (2) and 196 of the Motor Vehicles Act is sought to be quashed. 2. On a perusal of the case records, I find no reason to quash the prosecution as such. What exactly are the provisions of the Motor Vehicles Act attracted, will be decided by the learned Magistrate. Refusal to carry passengers in a public service vehicle will, no doubt, constitute offence punishable under the Motor Vehicles Act. I find substance in the allegation made by the police. However, decision will be taken by the trial court. The learned Magistrate will decide what exactly are the provisions attracted on the basis of the allegations made in the petty case charge-sheet.
In the result, this Crl.M.C is dismissed.
