Anilkumar vs Ashish

High Court Of Gujarat|22 February, 2012

JUDGMENT / ORDER

Pursuant to the order dated 13.4.2011 rendered in Criminal Misc.Application No.4649 of 2011 and other allied matters, all these 10 matters were ordered to be tagged together. However, Mr.Ajaykumar Choksi, learned advocate for the applicant in all these 10 matters submitted that out of these 10 matters, the above-referred six matters referred in the order, though the applicant is common, but the respondent No.1 - original complainant is different and even otherwise these six matters are arising from different Courts. It further transpires that in these six matters, though the respondent No.1 - original complainant came to be served with the notice, but none appeared for respondent No.1. All these six matters, together with remaining four matters are listed for 22 times, only for admission hearing, and it is submitted that since all these matters are tagged, even no progress is made in the remaining six matters despite the fact that for original complainant in those matters, none appears.
In above view of the matter, Registry is directed to release these six matters out of the tagged 10 matters and these six matters to be listed separately for admission hearing. S.o to 05.03.2012.
