Two other cases - O.P.(G & W) 1504/2013 and O.P. No. 1519/2013 - are pending on the file of the Family Court, Chavara. It is only proper that O.P.(HMA) No. 262/2012 between the same parties is transferred from the Family Court, Kollam to the Family Court, Chavara.
2. The wife has not chosen to enter appearance and oppose the prayer for transfer of the husband. All the three cases have to be tried by one and the same Family Court since the issues are intertwined.
3. I therefore order transfer of O.P.(HMA) No. 262/2012 from the Family Court, Kollam to the Family Court, Chavara. The Transferee Court shall issue notice to the parties and take the proceedings to a logical end soon.
The Transfer Petition is allowed.
