JUDGMENT / ORDER

Petitioner is the accused in Crime No.1625 of 2013 of Kayamkulam Police Station registered under Sections 294(b), 323, 324 and 506(ii) of the Indian Penal Code. Defacto complainant/2nd respondent is the wife of the petitioner. The crime was registered on the allegation that the petitioner physically assaulted the defacto complainant on 29.07.2013. It is also alleged in the first information statement that the petitioner was in the habit of meting out cruelty to the defacto complainant.
2. Heard the learned counsel for the petitioner and the learned counsel for the 2nd respondent/defacto complainant. Learned Public Prosecutor is also heard.
3. Learned counsel for the petitioner submitted that the husband and wife settled the matter through the intervention of well-wishers and they are now living together happily. Learned counsel for the defacto complainant also submitted that the parties have settled the matter. Considering the relationship between the parties and the fact that they have restored their relationship, I find that further proceeding with the matter would cause prejudice to the parties.
Crl.MC No.2469 of 2014 2 In the result, the petition is allowed. Annexure-2 final report in C.C.No.1423 of 2013 of Judicial First Class Magistrate Court, Kayamkulam is hereby quashed.
