The contention of the learned counsel for the petitioner is that without ascertaining the wishes of the members of the Gram Panchayat, the respondent no.7 could not have been appointed as Pradhan by the District Magistrate.
Learned counsel for the petitioner may serve a copy of the writ petition upon respondent no.7 by Dasti. The notice shall indicate that the case shall be taken up on 17.11.2021.
Place this petition on 17.11.2021 as fresh.
Learned Standing Counsel who represents the other respondents and the respondent no.7 may file counter affidavits by the next date fixed.
Till the next date of listing, the respondent no.7 shall not take any vital decisions pertaining to finance and appointment etc. as per the judgment of this Court in Udaivir vs. State Election Commission of U.P. through its Chairman & Ors. reported in 2009 (106) RD 151 wherein it has been held that the consent of the members of the Gram Panchayat had to be taken.
