Heard learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed with a prayer to quash the non-bailable warrant dated 27.10.2018 issued by Additional Sessions Judge Court No. 1, Ghaziabad in S.T. No. 717 of 2012 (State vs. Anil) under Section 302 IPC, Police Station Loni, District Ghaziabad.
Learned counsel for the applicant contended that due to illness, applicant could not appear before the court below. Therefore, the court has issued non-bailable-warrant against him.
I find no illegality in the impugned order passed by the court below.
In view of the above, the prayer for quashing non-bailable-warrant in the aforesaid case is refused.
However, it is directed that in case the applicant appears before the court below and applies for bail, his prayer for bail shall be decided expeditiously.
For a period of 30 days from today, the property of applicant shall not be attached under Section 83 Cr.P.C.
With the aforesaid directions, the instant application stands disposed of.
