Petitioners are accused Nos.1 and 2 in Crime No.244 of 2014 of the Karimkunnam Police Station for the offences punishable under Secs.323, 324, 341 and 326A r/w Sec.34 of the Indian Penal Code, apprehend arrest and have filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 06.05.2014 at about 4.30p.m, the petitioners along with the three accused wrongfully restrained and assaulted the de facto complainant. The third accused sprayed acid on his face causing burn injuries.
3. Learned counsel submits that the allegations are not true. At any rate, allegation of spraying acid is attributed to the third accused. It is submitted that the petitioners have no role in that. Learned counsel has invited my attention to the FIS to contend so. It is also submitted that for attacking the third accused, the police have registered Crime No.245 of 2014 against the de facto complainant, his father and others.
4. I have gone through the CD file. Having regard to the nature of allegations, request of the petitioners for pre-arrest bail B.A.No.3799 of 2014 2 cannot be allowed. It is directed that in case the petitioners are arrested, they shall be produced before the jurisdictional magistrate where it is open to them to request for regular bail. If any such application is preferred, learned magistrate shall consider the relevant circumstances and pass appropriate orders as early as possible.
The application is disposed of as above.
