Shri Vora, learned advocate appearing on behalf of the respondents has stated at the bar that as such the respondents are not in possession of the disputed suit property in question and one another person named, Shri Ashokbhai, is in possession of the suit property as a tenant. He has also stated at the bar that in view of the above, respondents nos. 1 and 2 as such do not claim any right and/or interest in the suit property in question either as a tenant or in another capacity. He has stated that an affidavit to the aforesaid effect is also filed by the respondents.
