Heard learned counsel for the petitioner.
Present petition has been filed seeking setting aside the impugned order dated 31.10.2017 passed by the Additional Principal Judge, Family Court, Meerut in Suit No. 891 of 2015 (Anil vs. Smt. Jyoti), whereby the application filed by the respondent under Section 24 of the Hindu Marriage act has been allowed.
As held by this Court in Matter under Article 227 No. 2313 of 2018, Yogish Arora Vs. Smt. Jennette Yogish Arora @ Miss Jennettee Dsouza, an appeal would be maintainable against the aforesaid order under Section 19 of the Family Courts Act.
This writ petition is, accordingly, dismissed on the aforesaid ground.
Office is directed to return the certified copy of the order to the learned counsel for the petitioner within a week after keeping a photo stat copy of the same on record.
This Court finds that the Stamp Reporter is still reporting petitions under Article 227 of the Constitution of India challenging the orders passed under Section 24 of the Hindu Marriage Act. Office was directed to supply a copy of the aforesaid judgment to the Stamp Reporter for necessary action. Office to do the needful.
