Heard Sri Vishal Agarwal, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
The grievance of the petitioner is that some private respondents are blocking public way by storing water which in a way causes nuisance.
The petitioner has submitted a representation in this regard to the District Magistrate (respondent No.2) on 21.01.2019 followed by representation dated 11.04.2019 and 21.11.2019 but with no action whatsoever.
In case there is any obstruction or public nuisance on any public place or way, the remedy is under Section 133 Cr.P.C.
In view of the above, we direct the District Magistrate (respondent No.2) to treat the above applications of the petitioner as a complaint under Section 133 Cr.P.C. and to take appropriate action in accordance with law most expeditiously.
