Heard learned counsel for the applicant, Sri Nipun Singh, learned counsel for the opposite party no.2 and learned A.G.A. for the State.
The present 482 application has been filed for quashing the impugned order dated 1.11.2018 passed by the Additional Chief Judicial Magistrate, Court No.1, Muzaffar Nagar in Misc. Case No.212/11 of 2018 (Navneet Bhardwaj Vs. Abhinav Swaroop and others) as well as reject the application moved by the opposite party No.2, U/S 156(3) Cr.P.C.
Sri Nipun Singh, learned counsel for the opposite party no.2 has raised objection that this application is premature and submitted that the impugned order has been passed by A.C.J.M. Court No.1, Muzaffar Nagar for recording the statement under Section 200 Cr.P.C., therefore, the application is not maintainable.
Sri Pramod Kumar Gupta, learned counsel for the applicant could not dispute the contention raised by Sri Nipun Singh, learned counsel for the opposite party no.2.
Accordingly, this application is dismissed as premature.
