Heard learned counsel for the applicant and learned AGA for the State.
The present application u/s 482 has been filed to quash the charge-sheet dated 06.10.2003, arising out of FIR dated 25.06.2003, under Sections 147, 332, 504, 506, 307, 452, 427 I.P.C., and section 7 C.L.A. Act, 1932, registered as Case Crime No. 47/2003, P.S. Matsena, District Firozabad as well as summoning order dated 09.03.2004 and N.B.W. order dated 29.05.2009.
While the non-bailable warrant has been issued against the applicant and they are pending execution since long, however, at present it is stated that an application has been filed by the A.D.G.C. (Criminal), Firozabad dated 22.10.2009 on the strength of recommendation made by the government dated 25.2.2009 to withdraw the prosecution against the applicant.
In view of the above fact, the present application is disposed of with the direction that the application dated 22.10.2009 may be decided first and process, if any, may be executed against the applicant only in the event of that application being rejected.
The aforesaid exercise may be concluded as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order.
