Heard counsel for the applicant, Sri Arun Kumar, counsel for the complainant and learned A.G.A. for the State.
According to the prosecution on 10.7.2018, the applicant along with Ranveer Singh and other accused in the case chased the deceased and Ranveer Singh fired at Vimlesh who died on the spot due to gun-shot injuries. A perusal of the post-mortem report shows that there is only one firearm injury on the deceased. Further, two other accused in the case, namely, Ram Niwas and Ashish have already been granted bail by this Court vide orders dated 11.12.2018 passed in Criminal Misc. Bail Application No. 46836 of 2018 and 14.12.2018 passed in Criminal Misc. Bail Application No. 47952 of 2018.
The role assigned to Ram Niwas and Ashish in the first information report is similar to the role assigned to the applicant. The role of the applicant is general in nature. The applicant is in jail since 18.8.2018.
Learned A.G.A. has vehemently opposed the prayer for bail but could not dispute the veracity of argument led by the learned counsel for the applicant.
Considering the submission of counsel for the parties, facts of the case, nature of allegation, period of custody, gravity of offence and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
Let applicant Anil @ Pintu involved in Case Crime No.212 of 2018, under Sections 147, 148, 149, 307, 302, 504, 506 IPC, Police Station Dannahar, District Mainpuri be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned subject to following conditions:
1. The applicant will not tamper with the evidence during the trial.
2. The applicant will not pressurize/intimidate the prosecution witness.
3. The applicant will appear before the trial court on the date fixed, unless personal presence is exempted.
4. The applicant shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected.
5. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
In case of breach of any of the above conditions, the court below shall be at liberty to cancel the bail.
