Case has been called out in the revised list. No one appears of the applicants. Mohd. Waseem, counsel for the opposite party no. 2 is present.
The present application u/s 482 Cr.P.C. has been filed for quashing the summoning order dated 10.8.2017 passed by A.C.J.M. Ist, Bareilly in Complaint Case no. 984 of 2017 (Smt. Shashi Patel vs. Anil Patel alias Teetu and others) u/s 498A, 323, 504, 506 I.P.C. and Section 3/4 D.P. Act, P.S. Baradari, District Bareilly.
On the proposal made on behalf of the applicants, matter was referred to Mediation centre and the applicants were directed to deposit Rs. 15,000/- with the Mediation centre of this Court within 30 days. Deputy Registrar/In-charge, Mediation centre has submitted report dated 12.10.2017 that the amount as directed by this Court, has not been deposited by the applicants.
Learned counsel for the opposite party no. 2 states that the applicants have not come up with clean hands and are enjoying benefit of interim order passed by this Court.
I have gone through the averments made in the complaint case with the assistance of counsel for opposite party no. 2 and learned A.G.A. In my opinion, prima facie offence is made out against the applicants inasmuch as in the complaint and in the statement recorded u/s 200 and 202 Cr.P.C. demand of dowry by the applicants and consequent torture has been stated.
I do not find any force in the present application, thus, the same is accordingly dismissed.
