An affidavit of compliance has been filed, the same is taken on record.
Heard Sri Akhilendra Yadav, learned counsel for the petitioners, Sri Vikas Sahai, learned A. G. A. for the State and perused the impugned F.I.R. as well as material brought on record.
This writ petition has been filed by the petitioners with the prayer to quash the F. I. R. dated 24.12.2017 registered as Case Crime No. 392 of 2017, under Section 307 and 323 IPC, P.S. Eka, District Firozabad.
Learned A.G.A. states that the victim has sustained injuries on her person to which learned counsel for the petitioners states that the injuries sustained by the victim are simple in nature. There is no case made out of offence u/s 307 IPC.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
