Heard learned counsel for the parties.
By means of this application, the applicant/appellant Anil Kumar Yadav is seeking leave to file an appeal against order dated 10.08.2009 passed by learned Single Judge of this Court in Civil Misc. Writ Petition No. 5885 of 2000, 'Shiv Chandra Vs. State of U.P. and Ors.', by which the petitioner/respondent no. 5, Shiv Chandra had challenged his termination order which was set-aside and petitioner/respondent no. 5, Shiv Chandra was reinstated. In our opinion, the applicant/appellant Anil Kumar Yadav, who was selected and appointed in the place of petitioner/respondent no. 5 in the vacancy resulting on account of termination of services of petitioner/respondent no. 5, has no locus to challenge the order passed by the learned Single Judge by which he had allowed the writ petition of the petitioner/respondent no. 5.
Accordingly, leave to file an appeal is refused and the application stands dismissed.
