Heard learned counsel for the petitioners; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 31.10.2019 registered as Case Crime No.391 of 2019, under Sections 323, 504, 506 IPC and Sections 3(1)(da) and 3(1)(Dha) of S.C./S.T. Act, P.S. Bhadohi, District Bhadohi.
The contention of the learned counsel for the petitioners is that the allegations levelled in the impugned first information report are false and that there is NCR from the side of the petitioners also.
Be that as it may, correctness of the allegations are not to be tested in writ jurisdiction, at this stage, where the allegations are to be taken on their face value.
Since the allegation discloses commission of cognizable offences, the prayer of the petitioners to quash the first information report cannot be accepted. The petition is dismissed without prejudice to the right of the petitioners to seek for bail as per advice.
