JUDGMENT / ORDER

Court No. - 16
Case :- WRIT - A No. - 9013 of 2018 Petitioner :- Anil Kumar Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rajesh Singh Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioner is aggrieved by an order, which requires the petitioner to vacate the premises allotted to him earlier. Application of the petitioner to continue on the ground that his son is studying in Class XI has been rejected.
Admittedly petitioner was transferred in 2014, and has been occupying the premises for last four years. After some argument, learned counsel for the petitioner comes up with the prayer to allow the petitioner to remain in premises for a month more, whereafter he shall voluntarily vacate the premises.
Learned Standing Counsel has no serious objection to such prayer of petitioner.
Considering the above, this writ petition stands disposed of with the observation that petitioner shall be allowed to continue in the official premises for a month more, and shall immediately vacate the official premises pursuant to order dated 21st March, 2018. In the event the petitioner fails to comply with undertaking given before this Court, it shall be open for the authorities to proceed against him, in accordance with law.
Order Date :- 30.3.2018 Anil
