It has been stated in the writ petition that a preliminary inquiry was instituted under Section 95(1) (g) of Uttar Pradesh Panchayat Raj Act, 1947 read with Rule 4 of Uttar Pradesh Panchayat Raj (Removal of Pradhans, Up-Pradhans and Members) Enquiry Rules, 1997 (hereinafter referred to as, 'Rules, 1997') against respondent no. 3 who is the elected Gram Pradhan of the Village. The inquiry report was submitted on 17.2.2018. However, it has been stated in the writ petition that despite submission of the inquiry report by the concerned Inquiry Officer, the District Magistrate, Kanpur Dehat has not taken any action/decision on the said report as mandated through Rule 5 of the Rules 1997.
It would serve no purpose to keep the writ petition pending. The petitioner may file a representation along with a certified copy of the present order before the District Magistrate, Kanpur Dehat i.e respondent no. 2 who shall decide the aforesaid representation expeditiously preferably within a period of three months from the date of filing of the said representation.
With the aforesaid direction, the writ petition is disposed of.
