Sri Amrendra Nath Rai learned counsel has put in appearance on behalf of respondent-bank.
The present petition has been filed with the prayer to quash the recovery citation dated 23.07.2018 issued by the Tehsildar, Tehsil Martinganj, Azamgarh pursuant to the demand notice issued by the respondent-bank.
On instruction, learned counsel for the respondent-bank submits that the recovery citation had been issued wrongly in the name of dead person as information regarding the deceased-loanee was not within the knowledge of the respondent-bank. Submission is that the appropriate steps would be taken for revocation of the recovery certificate dated 23.07.2018 and issuance of fresh demand to the petitioner and legal heirs of the deceased loanee.
In view of the above, the present petition is being disposed of with the direction that the petitioner shall approach the respondent-bank by providing the names of the heirs and legal representatives of the deceased-loanee and also move an application giving the details of the deposits made by the petitioner's father.
In case of such application being moved by the petitioner, the respondent-bank shall do the needful in accordance with law.
