Shri Ramendra Pratap Singh has filed his appearance on behalf of respondent no.5 in Court today. The same is taken on record.
Heard learned counsel for the petitioner and Shri Ramendra Pratap Singh, learned counsel for the respondent no.5.
The instant writ petition arises out of proceedings under Section 143 of the U.P. Zamindari Abolition and Land Reforms Act and is directed against the order of remand dated 27.03.2018 passed by Additional District Magistrate (Judicial) Gautam Budh Nagar.
Since, the order impugned is an order of remand in pursuance whereof, the petitioner still has every opportunity of raising all his pleas both on facts and on law, he cannot be said to be unduly prejudice by the impugned order.
For the same reason, this Court does not find it a fit case for interference.
The petitioner may contest the proceedings consequent to the order of remand raising all the possible pleas both on facts and on law in support of his case.
Subject to the above, this writ petition fails and is dismissed.
