Heard learned counsel for the petitioner.
This writ petition has been filed seeking directions for expeditious disposal of an application filed by the petitioner seeking the benefit of Section 67A of the U.P. Revenue Code, 2006.
This benefit is being sought regarding land, which prima-facie is under the management of the Nagar Palika Parishad, Pt. Deen Dayal Uppadhyay Nagar, Chandauli.
In my considered opinion, the benefit of Section 67A can only be granted against the Gaon Sabha as is clear from a perusal of the section itself.
However, since the application is pending before the Sub Divisional Officer, he is directed to decide the same keeping in mind the observations above by a speaking order within a period of four weeks from the date a certified copy of this order is filed before him.
Subject to the above, this writ petition stands disposed of.
Counsel appearing for the Nagar Palika Parishad is also directed to supply a copy of this order to the Sub Divisional Officer, where the application of the petitioner is pending consideration.
