Heard Sri Shailendra Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
The petition is directed against the order of cancellation of fire arms license dated 21.10.2019.
Learned Standing Counsel submits that the order is appealable.
At this stage learned counsel for the petitioner submits that he does not press the prayer sought in the writ petition and recasts his relief.
The only submission made by Sri Shailendra Kumar Tripathi, learned counsel for the petitioner is that because of Covid-19 pandemic there was a delay in approaching the competent authority. Now the limitation has expired.
The only prayer made on behalf of the petitioner is that the appeal may be decided on merits and not rejected on the ground of delay.
There is merit in the submission of learned counsel for the petitioner. Covid-19 pandemic has truly dislocated the normal life.
In the wake of preceding discussion, interests of justice will be served by issuing the following directions:
I. The petitioner may file an appeal within a period of one month from today along with an application for interim relief.
II. In case such appeal is filed within the time period stipulated above, the learned appellate authority shall decide the same on merits without going into the question of delay.
III. The learned appellate authority shall ensure that interim application is decided expeditiously so that the remedy of appeal does not become illusory.
With the aforesaid direction, the writ petition is finally disposed of.
