Learned counsel for parties are ad idem that the issues raised in this petition stand concluded in favour of the petitioner in light of the judgment rendered by a learned Judge of the Court in Satya Prakash Sharma & Others Vs. State of U.P. Thr. Its Prin. Sec. Home Deptt & Others [Service Single No.4127 of 2007]. The appeal of the State taken against the aforesaid decision has also been dismissed on 30 August 2019 and Special Leave Petition preferred against that judgment rejected on 18 November 2019, pursuant to which the same attained finality and the State Government has also proceeded to issue a Government Order of 29 May 2020 in compliance with the above.
In view of the aforesaid and with the consent of parties, this petition shall stand allowed. The impugned order dated 13 July 2007 is quashed. The petitioner is consequently held entitled to be placed in the regular pay band of Rs.4000-6000/-.
