Heard Sri Sharad Kumar, learned counsel for the petitioners, learned A.G.A. for the State- respondents and Sri Dhirendra Kumar Srivastava, learned counsel, who has put in appearance today, on behalf of the informant.
This writ petition has been filed praying for the following reliefs:
"(a) Issue a Writ of certiorari quashing the FIR dated 01.07.2021 (Annexure no.1 to writ petition), in case crime no. 0123 of 2021, under section 323, 325, 452, 504, 506 IPC, Police Station Kotwali Chunar, District-Mirzapur, be quashed, in the interest of justice.
(b) Issue a writ of mandamus directing the Respondent Authorities not to arrest the petitioners in case crime no. 0123 of 2021 under section 323, 325, 452, 504, 506 IPC, Police Station Kotwali Chunar, District- Mirzapur be stayed, in the interest of justice otherwise the petitioners shall suffer huge an irreparable loss and injury."
After the arguments were heard at some length, learned counsel for the petitioners states that the petitioners want to withdraw the writ petition with liberty to apply for anticipatory bail/ bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioners.
In view of the aforesaid, the writ petition is disposed off with liberty to the petitioners to apply for anticipatory bail/ bail as permissible under law and in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioners.
