The writ petition filed by the appellant for permitting him to correct the details in online application form filled by him for appointment to the post of Assistant Teacher was dismissed. This has led to the filing of this Special Appeal under Chapter VIII Rule 5 of the Allahabad High Court Rules.
Learned Judge has relied upon two Division Bench judgement of this Court rendered in Special Appeal No. 834 of 2013 decided on 30 May 2013 as well as Special Appeal (Def) No.117 of 2014 decided on 18.2.2014 to hold that such a mistake, particularly by a person aspiring to become a teacher cannot be permitted to be corrected.
Learned counsel for the appellant has submitted that it was due to inadvertent mistake that the petitioner had committed mistake in the online application form and that such a mistake should be permitted to be corrected.
In our opinion, the mistake committed in the online application form, unless there is provisions for correction of mistake within a stipulated time, cannot be permitted to be corrected. This is what has also been observed by a Division Bench of this Court in Special Appeal No. 90 of 2018 decided on 25 April 2018 (Jai Karan Singh and others Vs. State of U.P and others).
The writ-petitioner is a mature person and aspiring to become a teacher. At least the online application form should have been filled correctly but that was not done.
It was, therefore, not appropriate for the Court exercising jurisdiction under Article 226 of the Constitution of India to direct for correction of such mistake. The learned Judge was, therefore, justified in dismissing the writ petition.
The Special Appeal is, accordingly, dismissed.
