High Court Of Kerala|10 June, 2014

JUDGMENT / ORDER

The petitioner has filed this writ petition challenging Ext.P11 proceedings and Ext.P12 decision of the Managing Committee by which, he has been dismissed from the service of the 1st respondent. The contention of the petitioner is that, he was not paid the subsistence allowance that is legitimately due to him. After repeated representations, a portion of the subsistence allowance payable was paid, that too, the fag end of the domestic enquiry. For the above reasons, it is contended that, the principles of natural justice have been violated and that Ext.P11 report of the domestic enquiry as well as Ext.P12 resolution of the Managing Committee are liable to be set aside. The learned Government Pleader appears for the 2nd respondent.
2. I notice that, the petitioner has a statutory remedy, provided under Section 69 of the Kerala Co-operative Societies Act, 1969 against Exts.P11 and P12. He has admittedly not exhausted the said effective alternative remedy. For the above reason, I am not inclined to admit this writ petition or to grant any of the reliefs sought for. The petitioner shall be at liberty W.P.(C) No.14642 of 2014 2 to challenge Exts.P11 and P12 before the statutory appellate authority.
In view of the above, this writ petition is dismissed but, without prejudice to the statutory remedies available to the petitioner against Exts.P11 and P12.
