Challenge in this petition is to the F.I.R. registered at case crime no.11 of 2010 under section 3/7 of Essential Commodities Act read with sections 417, 418, 420, 120-B, 468, 470, 471 I.P.C police station Thakurdwara district Moradabad.
We have heard learned counsel for the petitioners, learned A.G.A. for the State and Shri Ravindra Singh, learned counsel for the Cane Development Societies Ltd.
The issues canvassed before us are the self same issues which have been elaborately argued in Criminal Writ Petition No. 1072 of 2010 in which while granting interim order staying the arrest of the petitioners, the petition has been posted for final hearing on 8.3.2010 alongwith other petitions involving similar issues. For detailed order, see order dated 25.1.2010 passed in writ petition no. 1072 of 2010.
Learned A.G.A. may file counter affidavit within four weeks. Learned counsel for the Cane Development Society may also file counter affidavit within the same period. Rejoinder affidavit, if any, may be filed within one week next thereafter. List this matter on 8.3.2010 alongwith writ petition no. 1072 of 2010.
Till then the arrest of the petitioners namely, Anil Kumar Tanwar, Tarun Sawhney, Nikhil Sawhneyand Dhruv Mohan Sawhney who are wanted in the case, as aforesaid, shall remain stayed.
