The present petition has been filed seeking the following relief:
"Issue, a writ, order or direction in the nature of mandamus directing the Respondent No. 2 to decide the representation of the petitioner dated 8.4.2021, which is pending for reinstatement in the service on the post of General Labour Category-I Northern Coalfield Ltd., Singrauli, O.B. Workshop Khariya Project, District Sonbhadra (U.P.) within stipulated time frame as fixed by this Hon'ble Court."
The contention of counsel for the petitioner is that the services of the petitioner were terminated only on account of pending criminal case in which the petitioner has been exonerated and the petitioner has filed representation for taking back in service.
The termination order has not been challenged in the present writ petition. In terms of the Rules applicable, an appeal lies challenging the termination order.
In view of the subsequent event i.e. discharge or acquittal of the petitioner in the criminal case, the writ petition is disposed off giving liberty to the petitioner to prefer an appeal against the termination order, annexing therein a copy of the judgement passed, whereby the petitioner has been exonerated, if such an appeal is filed within three weeks from today, the same shall be heard and decided in accordance with law without going into the question of limitation.
The petition is disposed off in terms of the said order.
Copy of the order downloaded from the website of Allahabad High Court shall be accepted/treated as certified copy of the order.
