Heard Shri Neeraj Tiwari, learned counsel for the petitioner and Shri Anant Tiwari, learned counsel appearing for the respondents.
The petitioner is aggrieved by the order dated 7.2.2014 whereby he has been placed under suspension (Annexure-9 to the writ petition). From a perusal of the impugned order of suspension it is noticed that the allegations against the petitioner are that he committed act of gross negligence and has injudiciously exercised his discretionary lending powers by sanctioning and disbursing loans to persons with fake identity and also on the basis of forged documents putting huge funds of the Bank in jeopardy. Further allegation is that he disbursed loan amounting to Rs.75.27 lacs as under:
(i) 25 Kisan Credit Cards and 8 dairy loans on the basis of forged land records;
(ii) 7 Joint Liability Group loans to persons with fake identity.
It is informed that charge sheet has been issued on 17.2.2014 (Annexure-11 to the writ petition) and the enquiry officer has also been appointed on 8.7.2014 and the enquiry is still in progress.
In view of the above and considering the allegations against the petitioner I do not find any good ground to interfere with the impugned order of suspension. The writ petition is accordingly dismissed.
It is however, directed that the respondents shall complete the enquiry within a period of three months from the date of receipt of certified copy of this order.
It is expected that the petitioner will cooperate in the enquiry proceedings.
The order of suspension dated 7.2.2014 shall be subject to the out come of the order which may be passed after final enquiry.
