This 482 Cr.P.C. application has been filed with a prayer to direct the trial Court to expedite the trial of Special Criminal Case No.7/2006 (State Vs. Anil Singh), arising out of Case Crime No.295 of 1995, under Sections 467, 468, 471, 420, 409, 120-B I.P.C. and Section 7/13 (D) read with Section 13(2) Prevention of Corruption Act, Police Station Baksa, District Jaunpur, pending inthe Court of Special Judge (Prevention of Corruption Act) III, Varanasi within a definite period.
Learned counsel for the applicant submits that charges have been framed against the applicant in the year 2012 but till date prosecution evidence has not been led and the applicant is being harassed.
Considering the facts of the case, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the trial Court, i.e.,Special Judge (Prevention of Corruption Act) III, Varanasi to decide the trial of the aforesaid case in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of eight months from the date of production of certified copy of this order, if there is no legal impediment.
