Heard Sri R.B. Singh, learned counsel for the petitioner and Sri M.S. Pipersenia, learned counsel for the respondent no.2.
The present petition is filed against the order dated 25.01.2018 passed by the Civil Judge (Junior Division), Chhibramau, Kannauj by which order the application being application No. 76-k(1) filed by the petitioner, was rejected on the ground that in the plaint there appears no lacuna pointed out with respect of change of boundary.
The order of the Civil Judge (Junior Division) was affirmed by the District Judge, Kannauj dated 23.01.2019.
During the course of argument, Sri M.S. Pipersenia, learned counsel for the respondent no.2 has pointed out that in the plaint filed before the Civil Judge, the description of boundary was clearly indicated that at the north side of the property, the plot belongs to one Lalu Gupta situates.
In view of the aforesaid, no interference is required by this Court and the orders passed by the Civil Judge and the District Judge are just and proper and therefore the same are affirmed.
