Learned counsel for the respondents states that against the order impugned dated 15.11.2019, the petitioner has a statutory remedy of filing departmental appeal.
Learned counsel for the petitioner states that the petitioner, however, is ready to avail the remedy of filing departmental appeal but the period of limitation in filing the departmental appeal has expired and hence, the petitioner has apprehension that his appeal may not be decided on merits.
Considering the above, the present petition is being disposed of with the directions as follows:
The petitioner shall file a departmental appeal along with the copy of this order within a period of three weeks from today. In case the appeal is filed within the time given above, the competent authority shall make all endeavour to decide the appeal on merits without raising any objection to the limitation in filing of the same, at the earliest, preferably, within a period of six weeks from the date of filing of the appeal.
